How the dates are counted · assumptions and sources

“Today” uses Pacific time. Entered dates are calendar dates, so daylight-saving changes do not add or remove a day. NOD arithmetic uses calendar months, with a disclosed last-day-of-month assumption when necessary. NOD milestones are not shifted to business days and are not an actual sale schedule.

The five-workday result is an office-planning reference, not a statutory deadline. It counts backward before the sale date, skipping Saturdays, Sundays and the closures below. Civil Code §9 can count Saturdays and has special rules for bank holidays. Newly proclaimed holidays, partial-day closures and the trustee’s actual receiving hours are not determined by this tool. Obtain a confirmed deadline and receiving instructions.

The planning calendar is reviewed for sale dates in 2026. Other years still get a sale-date count, but no five-workday date. Good Friday is excluded for a full day as a planning allowance; the statute specifies noon to 3 p.m. July 3, November 9 and the Friday after Thanksgiving are also planning allowances.

    The three questions

    Most notices become clearer when you separate the players, the clock and the decision.

    01 · Players

    Who is the trustee?

    The trustee conducts the nonjudicial foreclosure process. The mortgage servicer is the company handling the loan. They can be different entities.

    02 · Clock

    Which date actually matters?

    An NOD starts one stage of the process. An NOS identifies a scheduled sale. Do not rely on a solicitation’s deadline when the recorded notice gives the operative date.

    03 · Decision

    Keep, cure, modify, sell—or get advice?

    A market sale is only one path. CFPB also identifies repayment, forbearance, modification, short sale and deed-in-lieu as possible loss-mitigation paths depending on the loan and facts.

    Delinquency / servicer contact

    For many mortgages, the first foreclosure notice or filing generally cannot begin until the borrower is more than 120 days delinquent. Scope and exceptions matter. Read CFPB’s guidance.

    Notice of Default

    Recording the NOD formally advances a California nonjudicial foreclosure. The law uses a three-calendar-month period, with a limited early-recording provision for the sale notice. The tool shows these as separate reference dates.

    Notice of Trustee’s Sale

    The sale notice states the scheduled auction. California notice and publication requirements apply before the sale.

    Conditional sale-postponement provisions

    For qualifying residential 1–4 unit property, Civil Code §2924f includes one-time 45-day postponement provisions tied to timely delivery of a qualifying listing agreement and, after that postponement, a qualifying purchase agreement.
